EACC Reverts Grabbed Kibuye Market Land to Kisumu County
The Ethics and Anti-Corruption Commission (EACC) has recovered a parcel of land in Kisumu County that had been grabbed. The land, which is home to the Kibuye open air market, had been illegally transferred to an individual who was demanding Sh7 billion from the county government to release it.
The EACC CEO, Twalib Mbarak, said that the Commission was approached by Governor Anyang Nyong’o earlier this year to help recover the market land. The Commission conducted investigations and retrieved documents from the Ministry of Lands and Survey Department, which confirmed that the land was public property.
The EACC then initiated a legal process to recover the land. The process revealed that the individual who had claimed ownership of the land had no legal basis to do so. The EACC has now handed over the title deed to the county government, which can now proceed with its plans to modernize the market.
Governor Nyong’o hailed the EACC for recovering the market land, saying that it was a pointer that corruption can be defeated. He also warned land grabbers that their days are numbered, as the EACC is mandated to determine the rightful owner of all land in Kenya.
Court Rules It’s Illegal To Neglect Family Members Aged Over 60
Family members in Kenya who neglect their elderly relatives may be in violation of the Constitution, a Kitale court ruled on Wednesday, October 18, 2023.
Judge Anthony Charo Mrima emphasized that family members are legally obligated to provide “reasonable care and assistance” to their elderly kin.
“When members of a family of a person who is at least 60 years old and who are capable of providing care and assistance to such a person fail, refuse, ignore or neglect to discharge that duty, without any reasonable justification, then such persons stand in open violation of the Constitution,” Mrima ruled.
Judge Mrima’s ruling stemmed from a case related to a dispute over the distribution of the estate of the late Muiruri Kamau Gichuri. The estate involves two houses and their respective children, who are currently at odds regarding how the inheritance should be divided.
In Kenya, the government has established the National Council for Older Persons (NCOP), tasked with promoting the well-being, dignity, and welfare of elderly individuals in the nation. While there are guidelines and recommendations encouraging families to provide support to their elderly members, there exists no stringent legal requirement mandating family members to care for individuals aged 60 and above. Nonetheless, in Kenyan society, it is customary for family members to extend care and assistance to their elderly relatives as a reflection of cultural and social norms.
